What is the purpose of the Ontario’s Workplace Safety and Insurance Act?
The Workplace Safety and Insurance Act (WSIA) establishes a system which ensures that workers are compensated for work-related injuries and occupational diseases.
Who is not covered by OHSA?
Workplaces under federal jurisdiction are regulated by the Canada Labour Code, which is administered by Human Resources and Skills Development Canada. The OHSA does not apply to: post offices. airlines and airports.
Is it mandatory to have WSIB in Ontario?
WSIB coverage isn’t mandatory for everyone in Ontario. The Provincial Government decides which industries and which types of employees have to have WSIB coverage, and lists them in the Workplace Safety and Insurance Act (WSIA).
Can you opt out of WSIB?
Opting Out of WSIB: When workers find themselves in situations where WSIB is not mandatory, they may be able to choose whether they will opt for coverage under WSIB, or instead pursue some other benefit scheme or commence a lawsuit. There are various reasons workers might opt-out of WSIB benefits.
Who is not covered by Wsia?
Independent operators (IO), sole proprietors (SP), partners and executive officers (EO) are not covered under the Workplace Safety and Insurance Act, 1997 (WSIA) unless they apply for optional insurance or they are in the construction industry and are compulsorily covered.
